Charges have been dropped against an Albuquerque preschool owner accused of sexually assaulting a 3-year-old boy in his care, reported the Albuquerque Journal.

Dermot Newman, owner of Peppermint Stick Preschool in Albuquerque, was arrested and charged last October with raping the boy.

Now, after reviewing the case, the 2nd Judicial District Attorney's Office has dropped criminal charges, saying "we have determined that there is insufficient evidence to proceed with a prosecution at this time."

Meanwhile, the victim's mother, Romona Marquez Espinosa said "I'm devastated...I think the justice system has failed my son."

But the criminal system isn't the only option for justice in this situation. If a child is abused by a teacher, daycare workers, or others that child, and the parents on behalf of the child, may file a civil suit against the perpetrator and/or the institution that allowed the abuse to occur. Not only has the child suffered injury, but in these cases the child has frequently had his or her civil rights violated.
